1. Agreement

By completing your purchase, you (“Client”) agree to these Terms of Service, which govern all coaching, workshop, and digital services provided by Merge Creative LLC (“Company,” “we,” “our”).

This agreement becomes effective immediately upon purchase, regardless of whether the Client completes or attends scheduled sessions.

2. Payment Terms

All payments are processed securely through Stripe. You authorize Merge Creative LLC to charge your credit or debit card for the total amount shown at checkout.

  • Payment must be made in full unless a payment plan is expressly offered and selected at checkout.
  • For payment plans, your card will be automatically charged according to the agreed schedule until the full balance is paid.
  • If a payment fails, GoHighLevel’s automated system may pause access to sessions or materials until payment is successfully processed.
  • All prices are listed in U.S. Dollars (USD) unless otherwise stated.
  • Taxes, if applicable, will be added to your total at checkout.

3. Refund & Cancellation Policy

Because coaching and workshop access begin immediately upon purchase, all sales are final unless otherwise stated in a specific program guarantee.

1 on 1 Session Cancellation:

Clients may reschedule individual sessions with at least 24-hour notice. Missed sessions without notice will be forfeited.

No refunds are issued for missed or unused sessions, digital materials, or partial participation.

4. Scheduling & Access

  • All sessions must be scheduled and completed within the agreed program duration (e.g., 12 weeks, 8 weeks, etc.).
  • Group coaching and live workshops may include replays at the Company’s discretion. Access to recordings or materials is for personal use only and may be time-limited.
  • Merge Creative LLC reserves the right to reschedule sessions due to unforeseen circumstances. Clients will be notified and offered an alternate time.

5. Confidentiality

All information shared during coaching sessions is treated as confidential. We will not disclose client information without written consent, except where required by law.Group participants agree to maintain confidentiality regarding any personal information shared by other participants.

6. Results Disclaimer

Coaching is an educational and developmental process designed to support personal and professional growth.

Results vary depending on the Client’s effort, participation, and individual circumstances.

Merge Creative LLC does not guarantee specific outcomes, financial results, or success of any kind.

7. Intellectual Property

All content, materials, frameworks, videos, and tools provided (including The MERGE Process™, The Wayfinder Workshop™, and related materials) are the intellectual property of Merge Creative LLC.

You may use these materials for personal purposes only. You may not reproduce, distribute, sell, or share any part of this content without prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, Merge Creative LLC is not liable for any indirect, incidental, or consequential damages arising from participation in our programs or services.In no event shall the total liability exceed the amount paid by the Client for the program in question.

9. Chargebacks & Payment Disputes

Submitting a chargeback or payment dispute for services rendered is a violation of this agreement.

If a chargeback is initiated, your access to all programs will be revoked immediately.

We encourage Clients to contact us directly to resolve any concerns at kevin@businesscoachingforcreatives.combefore initiating a dispute.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in New Haven County, Connecticut.

11. Updates to Terms

Merge Creative LLC reserves the right to modify these Terms at any time. Updates will be reflected on our checkout pages and will apply to all new purchases after the date of revision.
